Regulator Keuangan Jepang akan Mengubah Dasar Hukum untuk Cryptocurrency

Regulator keuangan Jepang, Financial Services Agency (FSA) sedang mempertimbangkan untuk mengubah dasar hukum bagaimana mengatur mata uang cryptocurrency, media lokal Sankei melaporkan 3 Juli.

FSA dilaporkan sedang mempertimbangkan untuk mengatur bursa pertukaran kripto oleh Financial Instruments and Exchange Act (FIEA), bukan yayasan hukum saat ini, Undang-Undang Layanan Pembayaran. Menurut Senkai, ini berarti bahwa bursa akan memiliki perlindungan pelanggan yang lebih kuat. FIEA mewajibkan perusahaan efek untuk mengelola dana pelanggan dan sekuritas, seperti saham, secara terpisah dari aset perusahaan.

Berdasarkan undang-undang saat ini, cryptocurrency ditempatkan sebagai alat pembayaran yang sama dengan uang elektronik. Jika FSA mulai mengatur bursa pertukaran di bawah FEIA, maka mata uang kripto akan diperlakukan sebagai produk keuangan. FIEA juga akan membuka kemungkinan memperkenalkan turunan crypto seperti Exchange Traded Funds (ETF).

Sankei menulis bahwa 523 juta NEM yang dicuri di Coincheck awal tahun ini memberikan kontribusi kepada FSA yang mempertimbangkan landasan hukum yang berbeda untuk bursa pertukaran kripto.
