菲律宾认定加密货币云挖矿合约属证券

菲律宾证监会发布咨询回应，认为根据名为 Howey 检测的基准判断，加密货币云挖矿合约应该归类为证券。因为他们是投资合约，投资者通过合约获得远程数据中心的挖矿产能，并且可以进一步交易这些产能。文件要求，所有吸引公众投资这类挖矿合约的经纪商、推销员等相关方，应注册登记，或者寻求相应牌照，否则将被视为发行未注册登记的证券，面临刑事诉讼，可能处以最高 21 年的监禁。
